Pour avoir une chance de gagner un séjour à l’Hôtel Londres & New York, les participants doivent commenter avec leur occupation souhaitée pendant ce séjour à Paris sur la publication annonçant le concours sur @hotellondresnewyork sur Facebook ou Instagram.
Les participants aimant @hotellondresnewyork sur Facebook ou Instagram et partageant également la publication sur leur flux social gagneront une participation supplémentaire au tirage au sort.
Conditions essentielles
La participation au concours se fait via un commentaire sur la publication dédiée sur la chaîne Facebook ou Instagram de l’établissement. La date de clôture des inscriptions est le 1er février 2023 à minuit. Les participants doivent être âgés de plus de 18 ans pour être éligibles. Le prix doit être utilisé avant le 31 août 2023 et ne peut être utilisé conjointement avec une autre offre. Le prix peut être transféré par le gagnant à la personne de son choix. Il n’existe pas d’alternative en espèces au prix. Le voyage aller-retour à l’hôtel n’est pas inclus dans le prix. Le gagnant sera tiré au sort le 2 février 2023 et annoncé sur les pages Facebook et Instagram de la propriété. La propriété contactera également le gagnant directement via son compte de médias sociaux. Pour réclamer le prix, le gagnant doit contacter la propriété directement par e-mail ou par téléphone afin de réserver la chambre. La réservation de la chambre est soumise à la disponibilité. Si le gagnant est empêché d’honorer sa réservation, il est autorisé à le signaler une fois, à condition que la nouvelle date de réservation soit antérieure au 31 août 2023.
Facebook et Instagram ne gèrent ni ne soutiennent ce concours.
Les participants ajoutant des commentaires jugés offensants seront bannis du concours et signalés à Facebook et Instagram.

Hotel Londres & New York, ci-après » Hotel Londres & New York » , dont le siège social est situé au 15 PL DU HAVRE 75008 PARIS, et immatriculée sous le numéro 562019646, organise un Concours en ligne (ci-après le » Concours » ou le » Jeu-Concours « ) pour sa marque » Hotel Londres & New York « .
Les concours organisés sur la page Facebook® et Instagram® Hotel Londres & New York sont gratuits et sans obligation d’achat.
En participant aux différents concours via les pages Facebook® et Instagram® Hotel Londres & New York, les participants pourront s’inscrire au tirage au sort permettant à l’un d’entre eux de gagner un prix dont la nature est indiquée dans chacune des publications du concours concerné. Les concours sont accessibles sur les pages Facebook® et Instagram® de l’Hôtel Londres & New York.
Il est précisé que le Concours est développé et géré par Hotel Londres & New York à l’exclusion de tout parrainage ou intervention de Facebook® et Instagram®, qui ne font qu’héberger le Concours sur leurs Plateformes.
Le présent document constitue le règlement du Concours, ci-après dénommé le » Règlement « . Il pourra être complété et/ou modifié à tout moment pendant la durée du Concours par toute clause additionnelle qui entrera en vigueur du seul fait de sa mise en ligne par Hotel Londres & New York.
Toute personne est réputée avoir lu, compris et accepté, sans réserve, le Règlement dans son intégralité, et notamment l’article relatif aux données personnelles, dès lors qu’elle accède et s’inscrit au Concours.
L’ensemble des documents susmentionnés sont disponibles et accessibles à tous les utilisateurs et participants pendant la durée du Concours. Les utilisateurs et participants sont invités à effectuer une copie de sauvegarde et/ou à imprimer l’ensemble des textes susmentionnés afin de pouvoir s’y référer, le cas échéant.
Article 1 : Conditions d’accès
1.1.
La participation au Concours est ouverte à toute personne répondant aux conditions cumulatives ci-dessous :
(i) une personne physique majeure,
(ii) dispose d’un accès à Internet et d’une adresse électronique personnelle valide,
(iii) possède un compte Facebook® ou Instagram® et accède au concours via les plateformes Facebook® ou Instagram® de l’Hôtel Londres & New York pendant la période indiquée dans la publication du concours concerné.
L’Hôtel Londres & New York procédera, dans la limite des moyens mis à sa disposition, à la vérification du respect de ces critères. Dans le cas où l’un de ces critères ne serait pas respecté, l’inscription au concours ne pourra être validée.
1.2.
La participation au Concours est limitée à une participation au tirage au sort tel que détaillé à l’article 2 ci-dessous. Toutefois, les participants pourraient obtenir une participation supplémentaire en aimant l’un des canaux sociaux de la propriété et en partageant la publication du concours sur leur flux social Facebook ou Instagram.
1.3.
L’accès au concours est interdit aux employés de Hotel Londres & New York SAS, ainsi qu’à toute personne physique ou morale ayant collaboré ou collaborant à l’organisation du concours, y compris les membres de leur famille proche (ex : conjoint, concubin, enfant, sœur et frère, parent, partenaire de PACS).
Article 2 : Participation
2.1.
Le Concours est ouvert à toute personne remplissant l’ensemble des conditions mentionnées à l’article 1.1 ci-dessus, à l’exception de toute personne mentionnée à l’article 1.3.
Pour pouvoir participer au tirage au sort et tenter de remporter les prix en jeu à l’article 3.1, tout participant doit avoir effectué les actions mentionnées ci-dessous :

– Suivre les instructions de participation détaillées dans la publication dédiée
– Lire, comprendre et accepter sans réserve le règlement du concours disponible sur les pages susmentionnées et sur la page dédiée sur https://www.hotel-lny.com/offre-promotionnel/.
L’inscription au tirage au sort n’est effective qu’après l’accomplissement de ces étapes.
Il est entendu que chaque participant s’engage à révéler des informations correctes le concernant. L’Hôtel Londres & New York décline toute responsabilité dans le cas où un participant utiliserait de faux noms et/ou prénoms associés à une adresse e-mail valide, ou encore usurperait l’identité d’un tiers.
2.2.
La participation au Concours s’effectue exclusivement par voie électronique sur les pages Facebook® et Instagram® de l’Hôtel Londres & New York, le tirage au sort étant effectué parmi les participants inscrits sur ces dernières.
Toute participation au Concours sur papier libre ou sous toute autre forme est exclue.
2.3.
La participation au concours ne sera valable que si les informations requises par Hotel Londres & New York sont complètes et correctes.
Toute participation effectuée à l’aide d’informations incorrectes ou falsifiées ou via des formulaires contrefaits ou falsifiés entraînera automatiquement la perte de tout droit d’obtenir un quelconque prix gagnant.
2.4.
Chaque participant accepte de se conformer au Règlement. Tout manquement du Participant au Règlement, et notamment toute fraude, abus ou tricherie de sa part, pourra entraîner son exclusion du Concours sur décision de l’Hôtel Londres & New York.
En outre, en cas d’abus ou de tricherie d’un ou plusieurs participants, l’Hôtel Londres & New York se réserve le droit de modifier ou de mettre fin au Concours sans préavis, notamment si l’intégrité du Concours est mise en cause.
Article 3 : Détermination des gagnants – remise des prix
3.1. Prix
Le gagnant sera déterminé par tirage au sort parmi les participants via Facebook et Instagram. Ce gagnant remportera le lot indiqué dans la publication dédiée disponible sur la Plateforme. Les participants ne pourront prétendre à aucune indemnité ou contrepartie quelconque en cas d’annulation ou de perte autre que toute contrepartie offerte par l’organisateur. Le prix offert ne pourra faire l’objet d’aucune contestation d’aucune sorte, ni être échangé ou remplacé pour quelque raison que ce soit par Hotel Londres & New York. Si les circonstances l’exigent, Hotel Londres & New York se réserve le droit de remplacer le prix par d’autres prix de valeur équivalente.
3.2. Détermination des gagnants
Le gagnant sera déterminé par un tirage au sort qui sera effectué à la date mentionnée dans la publication dédiée, dans la base de données des personnes inscrites aux tirages au sort.
3.3 Information des gagnants / remise des prix
L’Hôtel Londres & New York informera les gagnants par message direct sur les médias sociaux le jour suivant le tirage au sort. A cette occasion, les gagnants seront informés des modalités de prise de possession de leur lot.
Les gagnants devront utiliser leur prix à partir de la date indiquée. Si les gagnants ne retournent pas leur prix dans le délai imparti, ils perdront leur prix sans que Hotel Londres & New York ne soit tenu pour responsable ou ne doive une quelconque compensation. Dans le cas d’un prix non électronique, la livraison du prix sera effectuée dans un délai de 90 jours à compter de la date de désignation du gagnant, par voie électronique ou au domicile du gagnant.
Nonobstant ce qui précède, la société organisatrice se réserve également le droit de conserver les lots qui auraient dû être attribués au gagnant défaillant et d’en disposer comme bon lui semble.
Article 4 : Modification / fin du concours
4.1.
Hotel Londres & New York se réserve le droit d’écourter, de proroger, de modifier ou d’annuler le Concours dans l’éventualité d’un cas de force majeure qui rendrait impossible la poursuite du Concours conformément aux dispositions du Règlement, et notamment en cas de dysfonctionnement du réseau Internet (dû à un virus ou non), de la Plateforme ou de tout autre problème lié aux réseaux, moyens et services de (télé)communication, ordinateurs (en ligne ou hors ligne), serveurs, fournisseurs d’accès Internet et/ou d’hébergement, équipements ou logiciels informatiques, données ou bases de données.
4.2.
Dans l’hypothèse où une telle annulation, modification, prolongation ou réduction de la durée du Concours interviendrait, Hotel Londres & New York s’engage à en informer les participants par email et/ou par publication sur la Plateforme via l’application dédiée et, le cas échéant, à leur communiquer les nouvelles règles applicables ou la nouvelle date de clôture du Concours.
En cas de modification du présent règlement au regard de ce qui précède, la poursuite du Concours par les participants inscrits sera considérée comme une acceptation des modifications apportées, et chaque participant aura la possibilité de se désinscrire du Concours en contactant Hôtel Londres & New York.
4.3.
En cas de modification des conditions du concours, d’annulation, d’interruption ou de réduction de la durée du concours, Hotel Londres & New York ne pourra être tenu pour responsable et les participants ne pourront prétendre à aucune indemnité, ce qu’ils acceptent.
4.4.
Enfin, chacun des participants accepte que l’Hôtel Londres & New York puisse mettre fin au Concours, ou y apporter des modifications à tout moment dans le cas où il constaterait un nombre significatif d’abus et de tricheries, que ce soit lors de l’inscription au Concours ou pendant le Concours lui-même.
L’annulation ou la modification du Concours sera communiquée aux participants par publication sur la Plateforme ou par tout autre moyen que Hotel Londres & New York jugera approprié.
Article 5 : Exclusion et limitation de responsabilité
Hotel Londres & New York ne peut être tenue responsable de tout dommage, direct ou indirect, quelles qu’en soient les causes, origines, natures ou conséquences, même si Hotel Londres & New York a été informée de la possibilité de tels dommages, causés par :
(i) un dysfonctionnement du réseau Internet ou de l’équipement informatique, y compris la Plateforme et l’application (matériel et/ou logiciel et/ou bases de données et/ou données) d’un Participant ou de toute personne ou société liée à l’organisation du Concours ou, plus généralement, de tout autre problème lié aux réseaux, moyens et services de (télé)communications, ordinateurs (en ligne ou hors ligne), serveurs, fournisseurs d’accès Internet et/ou d’hébergement, équipements ou logiciels informatiques, bases de données et données de toute personne ;
(ii) de la véracité des informations données par le Participant, et qu’il ne pourrait valablement considérer comme non conformes aux dispositions du présent règlement et des Conditions d’Utilisation au regard des informations et moyens en sa possession.
(iii) tout défaut de fabrication, panne ou autre dysfonctionnement, la conformité des lots aux normes auxquelles ils peuvent être soumis ou la sécurité d’utilisation des lots offerts (dans des conditions normales d’utilisation) qui ne sont pas ses propres produits.
L’Hôtel Londres & New York décline toute responsabilité pour les dommages causés par des événements indépendants de sa volonté, résultant de l’utilisation du prix, ou des services d’un fournisseur.
Article 6 : Frais de participation
Le Concours est gratuit et sans obligation d’achat.
Le règlement est disponible gratuitement pour les participants sur le site de l’Hôtel Londres & New York.
Pour les participants accédant au Concours par l’intermédiaire d’un modem et utilisant une ligne téléphonique facturée au temps passé – c’est-à-dire hors abonnement et forfaits de connexion par câble, ADSL ou spécialisés incluant ou offrant des frais de communication – les frais de connexion au site engagés pour la participation au Concours ne seront pas remboursés aux participants.
Article 7 : Litige
En cas de litige ou de réclamation concernant le Concours pour quelque raison que ce soit, les demandes doivent être adressées par écrit à l’attention de Hotel Londres & New York par courrier à l’adresse mentionnée sur le site de Hotel Londres & New York (https://www.hotel-lny.com/), pendant la durée du Concours et au plus tard soixante (60) jours après la désignation des gagnants.
En cas de litige ou de réclamation concernant les prix attribués, les demandes doivent être formulées par écrit à l’attention de l’Hôtel Londres & New York, par e-mail à contact@hotel-lny.com ou par courrier à l’adresse mentionnée en préambule dans les sept (7) jours suivant la réception de la confirmation du prix.
Chaque participant s’engage, en cas de difficulté qui pourrait survenir quant à l’application ou l’interprétation du Règlement, à rechercher une solution amiable avec l’Hôtel Londres & New York avant d’engager toute action judiciaire contre ce dernier.
Le Règlement est soumis à la loi française. Dans l’hypothèse où aucune solution amiable ne serait trouvée entre le(s) participant(s) et Hotel Londres & New York, tout litige découlant du présent règlement sera soumis au tribunal local de Hotel Londres & New York.
Article 8 : Données personnelles
Conformément aux dispositions de la loi du 2 août 2002 relative à la protection des personnes à l’égard du traitement des données à caractère personnel, aux fichiers et aux libertés, ainsi qu’à tous les textes relatifs à l’exécution des dispositions qui y sont énoncées, le participant est informé que toutes les informations demandées dans le formulaire d’inscription au Concours sont obligatoires, et mentionnées comme telles, et que le défaut de réponse à ces questions par le participant lui interdira de participer au Concours.
Les données collectées sont strictement nécessaires au bon déroulement du Concours. Toute utilisation à des fins autres que celles prévues par le présent règlement doit être expressément autorisée par le participant. En participant au Concours, le participant accepte le Règlement et la collecte desdites données. Les données seront supprimées dans les 12 mois suivant la fin du Concours, sauf accord exprès du participant.
Hotel Londres & New York peut publier et reproduire sur la Plateforme l’image, l’enregistrement vocal et le nom du gagnant, à condition que le gagnant y consente sur demande de Hotel Londres & New York.
En conséquence, les données collectées seront transmises uniquement à Hotel Londres & New York et à l’agence Pasol Interactive en sa qualité de sous-traitant pour l’organisation du Concours.
Chaque Participant dispose d’un droit d’accès, de rectification, de blocage et de suppression de ses données en contactant directement Hotel Londres & New York par email à contact@hotel-lny.com ou par courrier à l’adresse mentionnée en préambule.
Il est précisé à cet égard que toute demande de suppression de ces données par quelque moyen que ce soit pendant la durée du Concours pourra entraîner l’annulation de l’inscription au Concours.
Dans le cas où le participant manifeste expressément sa volonté de recevoir la Newsletter de Hotel Londres & New York, les données transmises seront alors collectées à des fins d’enquêtes, d’analyses ou dans le cadre d’opérations commerciales par Hotel Londres & New York, ses filiales, son réseau de vente et/ou toute société proposant un service pour le compte de Hotel Londres & New York.
Article 9 : Convention de preuve électronique
Hotel Londres & New York peut se prévaloir, notamment aux fins de preuve de tout acte, fait ou omission, des programmes, données, fichiers, enregistrements, opérations et autres éléments de nature ou de format ou support informatique ou électronique, établis, reçus ou conservés directement ou indirectement par elle ou les participants, sauf abus ou erreur manifeste. Les participants s’engagent à ne pas contester la recevabilité, la validité ou la force probante des éléments précités sur support ou format informatique ou électronique. Ainsi, les éléments considérés constituent des preuves et, s’ils sont produits comme moyens de preuve par Hotel Londres & New York S.A. dans toute procédure contentieuse ou autre, ils seront recevables et opposables entre les parties de la même manière, dans les mêmes conditions et avec la même force probante que tout document qui serait établi, reçu ou conservé par écrit.

One lucky winner and their guest will win an exclusive stay at the Hotel Londres & New York in Paris, the city of lights.
The prize includes the stay in a Superior Bedroom for up to 2 adults, visitor’s tax as well as buffet breakfast for all guests.
To be in with a chance of winning a stay at Hotel Londres & New York, participants must comment with your desired occupation during your stay in Paris on the publication announcing the competition on @hotellondresnewyork on Facebook or Instagram
Participants liking @hotellondresnewyork on Facebook or Instagram and also sharing the publication on their social feed will gain an extra entry to the draw.
Essential Terms and conditions
Entry to the competition is via comment on dedicated publication on the Facebook or Instagram channel of the property. Closing date for entries is 1 February 2023 at midnight. Participants must be over 18 to be eligible. Prize must be used before 31st of August 2023 and cannot be used in conjunction with any other offer. The price can be transferred by the winner to the person of his choice. There are no cash alternatives to the prize. Travel to and from the hotel is not included in the prize. The winner will be chosen at random on February 2nd 2023 and announced on the property’s Facebook and Instagram pages. The property will also contact the winner directly via his social media account. To claim the prize, the winner must contact the property directly via email or phone in order to book the room. Room booking is subject to availability. If the winner is prevented from honouring his booking, he is allowed to report it once, provided that the new booking date is before August 31st 2023.
Facebook and Instagram are not managing nor endorsing this competition.
Contestants adding comments deemed offensive will be banned from the competition and reported to Facebook and Instagram.

Preamble
Hotel Londres & New York, hereinafter « Hotel Londres & New York » , whose registered office is located at 15 PL DU HAVRE 75008 PARIS, and registered under number 562019646, is organising an online Contest (hereinafter the « Contest » or « Contest Game ») for its brand “Hotel Londres & New York”.
The contests organised on the Facebook® and Instagram® Hotel Londres & New York page are free of charge and without any obligation to purchase.
By taking part in the various contests via the Hotel Londres & New York Facebook® and Instagram® pages, participants will be able to enter the draw allowing one of them to win a prize, the nature of which is indicated in each of the Contest publications concerned. The contests are accessible on the Hotel Londres & New York Facebook® and Instagram® pages.
It is specified that the Contest is developed and managed by Hotel Londres & New York to the exclusion of any sponsorship or intervention by Facebook® and Instagram®, who only host the Contest on their Platforms.
This document is the rules of the Contest, hereinafter referred to as the « Rules ». They may be supplemented and/or modified at any time during the duration of the Contest by any additional clause that will come into force solely as a result of its online publication by Hotel Londres & New York.
Any person is deemed to have read, understood and accepted, without reservation, the Rules in their entirety, and in particular the article relating to personal data, as soon as they access and register for the Contest.
All of the above-mentioned documents are available and accessible to all users and participants during the duration of the Contest. Users and participants are requested to make a backup copy and/or print out all of the above-mentioned texts in order to be able to refer to them, if necessary.
Article 1: Conditions of access
1.1.
Participation in the Contest is open to any person meeting the cumulative conditions below:
(i) a natural person of legal age,
(ii) has Internet access and a valid personal email address,
(iii) has a Facebook® or Instagram® account and accesses the Contest via the Hotel Londres & New York Facebook® or Instagram® Platforms during the period indicated in the relevant contest publication.
Hotel Londres & New York will proceed, within the limits of the means at its disposal, to verify compliance with these criteria. In the event that one of these criteria is not met, registration for the Contest cannot be validated.
1.2.
Participation in the Contest is limited to one entry in the draw as detailed in Article 2 below. However participants could gain an extra entry by liking one of the property’s social channels and sharing the competition publication on their Facebook or Instagram social feed.
1.3.
Access to the Contest is forbidden to Hotel Londres & New York SAS employees, and to any natural or legal person having collaborated or collaborating in the organisation of the Contest, including members of their immediate families (e.g., spouse, partner, child, sister and brother, parent, PACS partner).
Article 2: Participation
2.1.
The Contest is open to anyone who meets all of the conditions mentioned in Article 1.1 above, with the exception of any person mentioned in Article 1.3.
In order to enter the draw and try to win the prizes at stake in article 3.1, any participant must have carried out the actions mentioned below:

– Go to one of the dedicated publications
– Follow the participation instructions detailed in the dedicated publication
– Read, understand and accept without reservation the Rules of the Contest available in the aforementioned pages and on the dedicated page on https://www.hotel-lny.com/offre-promotionnel/
Registration for the draw is only effective after these steps have been completed.
It is understood that each participant undertakes to reveal correct information about him or herself. Hotel Londres & New York declines all responsibility in the event that a participant uses false names and/or first names associated with a valid e-mail address, or even usurps the identity of a third party.
2.2.
Participation in the Contest is carried out exclusively by electronic means on the Hotel Londres & New York Facebook® and Instagram® pages, with the draw being made among the participants registered for the latter.
Any participation in the Contest on plain paper or in any other form is excluded.
2.3.
Participation in the competition will only be valid if the information required by Hotel Londres & New York is complete and correct.
Any entries made using incorrect or falsified information or via counterfeit or falsified forms will automatically forfeit any right to obtain any winning prize.
2.4.
Each participant agrees to comply with the Rules. Any failure by the Participant to comply with the Rules, and in particular any fraud, abuse, or cheating on his/her part, may result in his/her exclusion from the Contest by decision of Hotel Londres & New York.
In addition, in the event of abuse or cheating by one or more participants, Hotel Londres & New York reserves the right to modify or terminate the Contest without notice, particularly if the integrity of the Contest is called into question.
Article 3: Determination of the winners – delivery of prizes
3.1. Prizes
The winner will be determined by draw among the participants via Facebook and Instagram. This winner will win the prize indicated in the dedicated publication available on the Platform. Participants will not be entitled to any compensation or consideration whatsoever in the event of cancellation or loss other than any consideration offered by the organiser. The prize offered may not be contested in any way, nor may it be exchanged or replaced for any reason whatsoever by Hotel Londres & New York. If circumstances so require, Hotel Londres & New York reserves the right to replace the prize with other prizes of equivalent value.
3.2. Determination of the winners
The winner will be determined by a draw which will be carried out on the date mentioned in the dedicated publication, in the database of people registered for the draws.
3.3 Information of the winners / awarding of prizes
Hotel Londres & New York will inform the winners by social media direct message the day after the draw. On this occasion, the winners will be informed of the procedures for taking possession of their prize.
The winners will have to use their prize from the date indicated. If the winners fail to return their prize within the time limit, they will lose their prize without Hotel Londres & New York being held responsible or owing any compensation. In the case of a non-electronic prize, delivery of the prize will be made within 90 days from the date of designation of the winner, electronically or to the winner’s home.
Notwithstanding the foregoing, the organising company also reserves the right to keep the prizes that should have been awarded to the defaulting winner and to dispose of them as it sees fit.
Article 4: Modification / termination of the contest
4.1.
Hotel Londres & New York reserves the right to shorten, extend, modify, or cancel the Contest in the event of a case of force majeure that would make it impossible to continue the Contest in accordance with the provisions of the Rules and Regulations, and in particular in the event of a malfunction of the Internet network (whether due to a virus or not), the Platform or any other problem related to networks, means and (tele)communication services, computers (online or offline), servers, Internet access and/or hosting providers, computer equipment or software, data or databases.
4.2.
In the event that such a cancellation, modification, extension or reduction in the duration of the Competition should occur, Hotel Londres & New York undertakes to notify the participants by email and/or by publication on the Platform via the dedicated application and, where applicable, to inform them of the new rules applicable or the new closing date of the Competition.
In the event of any modification of these Rules with regard to the above, the continuation of the Contest by the registered participants will be deemed to be acceptance of the modifications made, and each participant will have the option of unsubscribing from the Contest by contacting Hotel Londres & New York.
4.3.
In the event of modification of the conditions of the competition, cancellation, interruption or reduction in the duration of the competition, Hotel Londres & New York cannot be held responsible and participants will not be entitled to claim any compensation, which they accept.
4.4.
Finally, each of the Participants accepts that Hotel Londres & New York may terminate the Contest, or make changes to it at any time in the event that it notes a significant number of abuses and cheating, whether during registration for the Contest or during the Contest itself.
The cancellation or modification of the Contest will be communicated to the participants by publication on the Platform or by any other means that Hotel Londres & New York deems appropriate.
Article 5: Disclaimer and limitation of liability
Hotel Londres & New York cannot be held responsible for any damage, direct or indirect, whatever the cause, origin, nature or consequences, even if Hotel Londres & New York has been advised of the possibility of such damage, caused by:
(i) a malfunction of the Internet network or computer equipment, including the Platform and the application (hardware and/or software and/or databases and/or data) of a Participant or of any person or company linked to the organisation of the Contest or, more generally, of any other problem related to the networks, means and services of (tele)communications, computers (online or offline), servers, Internet access and/or hosting providers, computer equipment or software, databases and data of any person;
(ii) the truthfulness of the information given by the Participant, and that it could not validly consider as not complying with the provisions of these rules and the Conditions of Use with regard to the information and means in its possession
(iii) any manufacturing defect, breakdown or other malfunction, the conformity of the prizes to the standards to which they may be subject or the safety of use of the prizes offered (under normal conditions of use) that are not its own products.
Hotel Londres & New York declines all responsibility for damage caused by events beyond its control, resulting from the use of the prize, or from the services of a supplier.
Article 6: Participation fees
The Contest is free of charge and without obligation to purchase.
The Rules are available to participants free of charge on the Hotel Londres & New York website.
For participants accessing the Contest via a modem and using a telephone line billed according to the time spent – i.e. excluding cable, ADSL or specialised connection subscriptions and packages including or offering communication costs – the costs of connecting to the site incurred for participation in the Contest will not be reimbursed to participants.
Article 7: Dispute
In the event of a dispute or claim concerning the Contest for any reason whatsoever, requests must be sent in writing to the attention of Hotel Londres & New York by mail to the address mentioned on the Hotel Londres & New York website (https://www.hotel-lny.com/), during the duration of the Contest and no later than sixty (60) days after the winners have been named.
In the event of a dispute or claim regarding the prizes awarded, requests must be made in writing to the attention of Hotel Londres & New York, by e-mail to contact@hotel-lny.com or by post to the address mentioned in the preamble within seven (7) days of receiving confirmation of the prize.
Each participant undertakes, in the event of any difficulty that may arise concerning the application or interpretation of the Rules, to seek amicable settlement with Hotel Londres & New York before taking any legal action against the latter.
The Rules are subject to French law. In the event that no amicable solution is found between the participant(s) and Hotel Londres & New York, any dispute arising from these Rules will be submitted to Hotel Londres & New York’ local court of law.
Article 8: Personal Data
In accordance with the provisions of the law of August 2, 2002 on the protection of persons with regard to the processing of personal data, files and freedoms, as well as all the texts relating to the execution of the provisions set forth therein, the participant is informed that all the information requested in the registration form of the Contest is mandatory, and mentioned as such, and that failure to answer these questions by the participant will prohibit him/her from participating in the Contest.
The data collected is strictly necessary for the proper conduct of the Contest. Any use for purposes other than those set out in these Rules must be expressly authorised by the participant. By participating in the Contest, the participant accepts the Rules and the collection of said data. The data will be deleted within 12 months of the end of the Contest, unless the participant expressly agrees otherwise.
Hotel Londres & New York may publish and reproduce on the Platform the image, voice recording, and name of the winner, provided that the winner consents to this upon request by Hotel Londres & New York.
Consequently, the data collected will be transmitted solely to Hotel Londres & New York and to the Pasol Interactive agency in its capacity as subcontractor for the organisation of the Contest.
Each Participant has the right to access, rectify, block and delete his/her data by contacting Hotel Londres & New York directly by email at contact@hotel-lny.com or by mail at the address mentioned in the preamble.
It is specified in this respect that any request for deletion of this data by any means whatsoever during the duration of the Contest may result in the cancellation of registration for the Contest.
In the event that the participant expressly states his/her wish to receive the Hotel Londres & New York Newsletter, the data transmitted will then be collected for the purposes of surveys, analyses or in the context of commercial operations by Hotel Londres & New York, its subsidiaries, its sales network and/or any company offering a service on behalf of Hotel Londres & New York.
Article 9: Agreement of electronic proof
Hotel Londres & New York can take advantage, in particular for the purposes of proof of any act, fact or omission, of the programs, data, files, recordings, operations and other elements of a nature or in a computerised or electronic format or medium, established, received or retained directly or indirectly by it or the participants, except in the case of abuse or obvious error. Participants agree not to contest the admissibility, validity or probative value of the aforementioned elements in computer or electronic format or medium. Thus, the elements considered constitute proof and, if they are produced as means of proof by Hotel Londres & New York S.A. in any litigation or other procedure, they will be admissible and opposable between the parties in the same way, under the same conditions and with the same probative force as any document that would be established, received or kept in writing.
